President Bush versus his own military's top judges. Whew!
Now what? If President Bush can't get his top judges in the military (right) to agree with his new torture plan, what is he to do? Just dictate it (he says he can!) ... or negotiate ... or back off?
A couple of examples: "I can't imagine any military judge believing that an accused has had a full and fair hearing if all the Government's evidence that was introduced was classified and the accused was not able to see any of it." That gem from the Navy's Judge Advocate General, Rear Admiral Bruce E. MacDonald..
Another: "I'm not aware of any situation in the world where there is a system of jurisprudence that is recognized by civilized people, where an individual can be tried and convicted without seeing the evidence against him. And I don't think that the United States needs to become the first in that scenario." That even more strongly worded statement from BG James Walker, US Marine Corps and Staff Judge Advocate.
And so it goes ...
As it stands now, the Republican supporters of Bush's "Tribunal Plan" are pushing to have it voted on and passed by the Republican Congress in time to show the American people who is really tough on terror ... before the November midterm elections.
Maybe I was wrong in stating that the doctored ABC special was of little concern (previous posting). The Republicans are pushing even the Constitution aside to show that they are the "touhgies on terror" who must be elected and control Congress for at least two more years.
